Two tax years, five days apart

India's year starts on 1 April. The UK's on 6 April.

The two years almost line up, which makes India–UK planning simpler than most countries. Income received between 1 and 5 April falls in a new Indian year but the old UK year, so we time sales and remittances around it.

UK rule change · 6 April 2025

The end of non-dom status puts Indian income on your UK return.

The UK abolished the remittance basis. Most UK residents are now taxed on worldwide income as it arises, including rent, interest and gains from India, so the Indian figures have to be right.

Reported every year

Indian income goes on the SA106 foreign pages. We prepare it in the format your UK accountant needs.

4-year FIG regime

New arrivals after 10 years abroad may exempt foreign income for four UK tax years.

Credit for Indian tax

TDS certificates and computations from us support UK foreign tax credit relief.

Asset sales

We work out Indian tax first, then give your UK adviser the workings for UK capital gains.

Simplified for a UK resident with Indian income. Your accountant will confirm how the rules apply to you.

Working with your UK accountant

We handle India. Your UK accountant handles HMRC.

Your Self Assessment or company accounts stay with your UK adviser. We make sure the Indian figures and certificates they rely on are complete and correct.

India–UK tax treaty

How the treaty stops double taxation.

India and the UK signed their Double Taxation Avoidance Agreement in 1993, updated by a protocol in 2013. It decides which country taxes which income first and makes the other give credit.

01

Work out where you're resident

India counts your days in India. The UK applies its Statutory Residence Test. If both treat you as resident, the treaty's tie-breaker tests decide.

02

Indian property is taxed in India

Rent and gains from property in India are taxed in India first. A UK resident also reports them in the UK and claims credit.

03

Lower rates on investments

The treaty caps Indian tax on interest, dividends, royalties and fees paid to UK residents who hold a certificate of residence and file Form 10F.

04

Credit for tax already paid

Indian tax is credited against UK tax on the same income through foreign tax credit relief on your Self Assessment.

Repatriation · Form 145 and 146

How your money moves from India to the UK.

NRIs can generally remit up to USD 1 million each financial year from an NRO account once Indian tax is paid. From 1 April 2026, Forms 145 and 146 replaced Forms 15CA and 15CB.

01

We compute the Indian tax and confirm it has been paid or deducted.

03

04

You file the online declaration, and we fill it in to match the certificate.

05

Bank remits

NRE and FCNR balancesare freely repatriable. Only NRO funds need the certificate route.
Gifts from family in Indiacan be sent under the Liberalised Remittance Scheme, with its own limits.
Keep proof of sourcesuch as the sale deed or inheritance papers, so the bank's check is quick.
NRE, NRO and FCNR accounts

Which Indian bank account does what.

Most NRIs in the UK hold more than one type of Indian account. Each is taxed and repatriated differently in India, and the UK treats them differently again.

Questions

What NRIs and UK businesses ask us.

General guidance only. Every case is different, so please speak to us before acting on any of this.

Do I need to file an Indian tax return if I live in the UK?
Often, yes. As an NRI you're taxed in India on income earned or received in India, such as rent, NRO interest, dividends and capital gains. You need to file if that income is above the basic exemption limit, if you sold property or shares, or if you want a refund of excess TDS.
Do I also have to report my Indian income to HMRC?
If you're UK resident, usually yes. Since the remittance basis ended in April 2025, most UK residents are taxed on worldwide income as it arises, reported on the SA106 foreign pages. New arrivals after 10 years of non-residence may claim the 4-year FIG exemption instead.
Will I be taxed twice on the same Indian income?
Not in full. Under the India–UK treaty, India usually taxes Indian-source income first, and the UK gives foreign tax credit relief for that tax. We provide the Indian computations and TDS certificates your UK accountant needs.
Can I sell my property in India and move the money to the UK?
Yes. The buyer deducts TDS, which a lower deduction certificate can reduce. Once tax is settled, you can generally remit up to USD 1 million per financial year from your NRO account, supported by Form 145 and the Form 146 CA certificate.
What replaced Forms 15CA and 15CB?
From 1 April 2026, Form 145 (the remitter's declaration) and Form 146 (the Chartered Accountant's certificate) replaced Forms 15CA and 15CB for foreign remittances.
Does my British passport or OCI card decide my Indian tax status?
No. Indian tax residence depends mainly on how many days you spend in India in a financial year, with extra rules for Indian citizens and persons of Indian origin.
Can a UK company fully own an Indian subsidiary?
In most sectors, yes, under the automatic route for foreign investment. The company needs at least two directors with one resident in India, and must report the investment to the RBI and file an annual FLA return.
Is interest on my NRE account taxable in the UK?
NRE interest is tax-free in India for NRIs, but if you are UK resident it is usually taxable in the UK as foreign income. Since there is no Indian tax on it, there is no credit to claim. We give your UK accountant the interest figures for each account.
Can I file my Indian tax return without travelling to India?
Yes. Returns are filed online and verified electronically, and documents can be shared and signed digitally. Most of our UK clients never need to visit India for their tax work.
Do I need a PAN if I live in the UK?
If you have taxable income in India, sell property or shares, or want to claim a TDS refund, you need a PAN. We can help you apply for one or update an existing PAN with your current address and status.
What is RNOR status and how long does it last?
Resident but Not Ordinarily Resident is a transition status for people returning to India. During it, most income earned outside India stays outside Indian tax. Whether you qualify, and for how long, depends on your past years of residence, so we work it out before you move.
How early should I apply for a lower TDS certificate before selling property?
As early as you can, ideally as soon as a buyer is agreed. The certificate must be in place before the buyer makes the payment, and processing can take several weeks.
Will you replace my UK accountant?
No. We're Chartered Accountants in India and we handle Indian tax, FEMA and company work. Your UK return stays with your UK accountant, and we work alongside them.
