Revocable trusts:flexibility you keep.

In a revocable trust, the person creating it can take the assets back or change the terms. That flexibility comes with a tax rule: income from the assets stays taxable to the settlor. NRIs and UK families use revocable trusts to have assets managed in India during their lifetime and passed on smoothly.

When it helps.

  • Managing from abroadTrustees in India manage property for an NRI.
  • IncapacityAssets keep being managed if the settlor cannot act.
  • SuccessionAssets pass under the deed on death.
  • Testing a structureBefore committing to an irrevocable trust.

Trust or will?

A will only takes effect on death and may need probate. A revocable trust works during life too, but costs more to set up because of stamp duty on property. Many families use both. See Estate Planning.

This page is general guidance based on the Indian Trusts Act, 1882, state public trust laws and Indian tax law as they stand. It is not legal advice for your situation. Trust deeds should be drafted by a lawyer, and UK tax advice is needed where settlors, trustees or beneficiaries are UK resident.
